These General Terms and Conditions of Sale govern the offer and sale of the products available on the website www.s-line.it (hereinafter, the “Website”).
Products purchased through the Website are sold by SL Srl, with registered office in Bellusco (MB), Via dell'Artigianato 13/15 (VAT No. IT06386430968), share capital € 10.000,00 fully paid-in, PEC: postacertificata@pec.s-line.it.
1. Scope of application
1.1 The sale of products through the Website (hereinafter “Products”) constitutes a distance contract governed by the Italian Consumer Code (Legislative Decree 206/2005, Arts. 45 et seq.) and by the rules on electronic commerce (Legislative Decree 70/2003).
1.2 These Terms may be updated at any time. Changes take effect from the moment they are published on the Website. Users are therefore invited to consult them regularly before making purchases. The terms in force at the time the order is submitted shall apply.
1.3 These Terms do not govern the sale of products or services offered by third parties that may appear on the Website via links or hyperlinks. Before carrying out transactions with such parties, their terms of sale must be consulted. SL Srl is not responsible for content, services or products provided by third-party sites and does not carry out checks on them.
2. Purchases on the Website
2.1 Access to sales is reserved exclusively to users of legal age (18 years or older).
2.2 Only consumers, as defined by Art. 3 of the Consumer Code, may purchase, i.e. natural persons acting for purposes unrelated to their professional or business activity.
2.3 SL Srl reserves the right to refuse or cancel orders from users who:
- have ongoing disputes;
- have breached previous contractual terms;
- are involved in fraud or suspected fraudulent activities;
- have provided false or incomplete data or have not submitted requested documents;
- do not offer adequate guarantees of solvency.
3. Registration on the Website
3.1 Purchases may be made by both registered and non-registered users.
3.2 Login credentials are personal and non-transferable. The user must keep them confidential and not allow third parties to use them. In the event of improper use or suspected theft of credentials, the user must immediately inform SL Srl.
The user warrants the truthfulness of the data provided and undertakes to hold SL Srl harmless from any damage or consequence arising from breaches of these rules.
4. Conclusion of the contract
4.1 Pursuant to the rules on electronic commerce, SL Srl informs that:
- to make a purchase the user must complete and submit an electronic order form following the Website procedures;
- the contract is deemed concluded when the order is considered shipped and handed over to the courier for delivery;
- after payment verification, SL Srl will send a confirmation e-mail containing an order summary, applicable terms, product features, price, costs, shipping and billing details, as well as customer service contacts.
It is recommended to keep the e-mail as proof of purchase.
The order form will be stored in SL Srl systems for the time necessary to manage the order and according to statutory time limits.
5. Prices and validity of offers
5.1 All prices are expressed in euro and inclusive of VAT. Any additional costs will be clearly indicated before order confirmation and in the summary e-mail.
5.2 Prices may be changed at any time, but the price applied will be the one visible at the time the order is submitted. Subsequent changes will not be taken into account.
5.3 The Website may offer discounted products compared to the list price (strikethrough price), which represents the original price. Such value is indicative and may differ from physical points of sale.
6. Orders and product information
6.1 Order fulfilment takes place only after confirmation of payment of the total amount due (price, shipping and any additional costs). In the event of non-payment or a negative outcome, the contract is deemed automatically terminated and the order cancelled.
6.2 Products remain the property of SL Srl until full payment. The risk of loss or damage passes to the user upon delivery.
6.3 Each product is accompanied by a descriptive sheet. Images and descriptions are indicative and may not perfectly represent the actual product, including due to display differences or graphic features. In case of discrepancies, the description stated in the order prevails.
7. Product availability
7.1 Products are available in limited quantities and may sell out even as a result of simultaneous orders.
7.2 In the event of unavailability, the user will be promptly informed by e-mail and may terminate the contract, with the right to a refund within 15 working days, according to applicable law.
7.3 In the case of multiple orders, the unavailability of one or more products will result in a refund of only the unavailable parts, including the related shipping costs. Cancellation of the entire order is possible only if the missing products are essential with respect to the others purchased.
8. Delivery of purchased Products
8.1 Delivery of the Products is available in Italy and abroad via standard or express shipping. Any logistical limitations will be indicated on the Website or by e-mail.
8.2 Delivery charges, where applicable, are indicated in euro and inclusive of VAT during the order process, in the summary and in any case before purchase confirmation. In the absence of a specific deadline, delivery will take place within 30 days of conclusion of the contract.
8.3 In the event of partial withdrawal from Multiple Orders, shipping costs will not be refunded proportionally to the returned products.
8.4 Delivery is deemed effected upon transfer of the physical availability of the goods to the user or to a third party designated by them.
Upon delivery, the customer is invited to carefully check the condition of the packages and their integrity. The risk of loss or damage transfers to the customer when the goods enter their physical availability.
It is recommended to check the packaging and, in the event of evident anomalies, to accept delivery with a specific reservation on the courier's document.
Receipt without reservations does not necessarily preclude the possibility of asserting one's rights against the carrier, within the limits provided by applicable law, in particular in the case of defects not immediately recognisable or of wilful misconduct or gross negligence of the carrier. Any defects must in any case be reported within the statutory time limits from discovery.
In the event of tampered or altered packaging, please promptly contact Customer Service.
The courier makes up to two delivery attempts; thereafter the parcel will be returned to SL Srl and refunded according to the terms of sale. No amount is due to the courier upon delivery.
9. Payment methods
9.1 The following payment methods are accepted: PayPal and bank transfer. Any limitations will be indicated on the Website.
9.2 Where requested, the invoice is issued in electronic format. The user warrants the truthfulness of the data provided and holds SL Srl harmless from any consequence arising from incorrect information.
Credit/debit cards
9.3.1 VISA, Mastercard and American Express circuits are accepted via PayPal. Charging takes place only after authorisation by the issuing institution.
9.3.2 For anti-fraud security purposes, SL Srl reserves the right to suspend the order where checks are necessary. In such cases, identity documents may be requested, limited to what is strictly necessary to verify the identity of the payment holder.
9.3.3 In the event of a negative outcome of the checks, the contract is deemed terminated and the order cancelled with a refund of any amount already paid.
9.3.4 Card data are not stored by SL Srl, but are managed exclusively by the payment circuits.
PayPal payment
9.4.1 Payment via PayPal takes place according to PayPal's service terms. The user's data are processed directly by PayPal.
9.4.2 In the event of a refund, the amount will be credited to the PayPal account used. Credit times depend exclusively on the banking circuit and on PayPal.
10. Right of withdrawal
10.1 The consumer has the right to withdraw from the contract without giving any reason within 14 calendar days.
The period runs:
a) from delivery of the single product;
b) from delivery of the last product in the case of multiple orders;
c) from delivery of the last batch in the case of split products.
10.2 Withdrawal must be communicated within the prescribed period using the form available on the Website or another explicit declaration.
10.3 The customer may use the withdrawal form available on the Website.
10.4 Return shipping costs are not borne by SL Srl. The product is deemed returned upon delivery at the company's premises after inspection of the package contents.
10.5 The refund will be made within 14 days of communication of withdrawal and will include the price paid and standard shipping costs, where applicable. The refund will be made using the same payment method used.
10.6 In the event of partial withdrawal, the refund of shipping costs will be proportional.
10.7 The product must be returned intact, complete and unused beyond what is necessary to establish its nature and functioning.
10.8 In the event of non-compliant withdrawal, SL Srl may refuse the refund and return the product to the customer.
10.9 Any reduction in the value of the product may be deducted from the refund.
10.10 The right of withdrawal is excluded in the cases provided for by applicable law, including customised or sealed products that have been opened.
10.11 It is possible to access a voluntary returns service according to the conditions indicated on the Website, independent of the right of withdrawal.
11. Discount codes
11.1 Purchases on the Website may also be made using discount codes issued by SL Srl. If the value of the discount code is lower than that of the order, the remaining amount may be completed according to the other payment methods provided on the Website.
11.2 Discount codes are not cumulative with each other for a single purchase. Discount codes may not be used to purchase products already on promotion. It is not possible to use discount codes for payments of amounts lower than their value. Each discount code may be used for a single purchase. Under no circumstances do discount codes entitle the holder to change where purchases are of a lower amount.
11.3 Any products for which discount codes cannot be used will be duly indicated on the Website. In the event of cancellation for any reason of an order for which a discount code was used, the related amount will be re-credited to the customer's personal account.
11.4 Under no circumstances may discount vouchers be converted into cash.
12. Legal guarantee of conformity
All Products are covered by the legal guarantee of conformity pursuant to Legislative Decree 170/2021 and applicable consumer protection legislation.
Scope of application
The guarantee applies exclusively to consumers.
Duration
The seller is liable for lack of conformity existing at the time of delivery and becoming apparent within 2 years.
The defect must be reported within 2 months of discovery.
Lack of conformity
There is a lack of conformity when the product does not comply with:
- the habitual use of the goods;
- the description provided;
- the quality and performance reasonably expected;
- a specific use communicated to and accepted by the seller.
Defects arising from improper use, negligence or external causes are excluded.
Remedies
The customer is primarily entitled to replacement of the product or, if impossible, to termination of the contract.
Procedure
The customer must contact Customer Service to open the case.
Refund
In the event of termination, the full amount paid will be refunded, including shipping costs.
Alternatively, a purchase voucher may be issued.
13. Applicable law and competent court
13.1 The contract is governed by Italian law, without prejudice to any more favourable rules of the consumer's country of residence.
13.2 The competent court is that of the consumer's place of residence or domicile.
13.3 It is possible to resort to alternative dispute resolution (ADR) systems, according to applicable law.
13.4 It is also possible to access the European small claims procedure for cross-border disputes (Reg. EC 861/2007), where applicable.
